Determining liability

When a client receives a claim, the first task is to establish whether the business in its current form has any liability for acts or omissions – some of which may have taken place as long ago as 50 years previously.

Our Corporate Liability Investigation Team has the skills needed to be able to investigate and analyse your client’s corporate history through contemporaneous company documents and accounts. This demands a detailed knowledge of company law, insurance law, employment law, as well as an understanding of the various available data sources.

Where there is potential for a contribution to the claim and/or recovery of your client’s outlay, we can carry out corporate liability investigations to identify the entity who is liable for the recovery/contribution.

Additionally, we can also liaise with the Financial Services Compensation Scheme (“FSCS”) where there is an inactive or dissolved company with no insurance cover in place.

Identifying insurance

BAI Claims Services is a specialist in the Employers’ Liability Tracing Office database (ELTO) with extensive market knowledge and experience. We can assist by tracing historical insurance cover and consequently, reducing potential claims costs.

In addition, we have been active participants in ELTO since its formation; indeed, our organisation is represented on the ELTO Advisory Board. This involvement provides us with links to both the live and run-off markets and allows us to be at the forefront of any developments in this evolving area.

We have also provided training and support to other organisations in the use of the ELTO tracing services.

We trace insurance for clients in both the live and run-off market sectors. This provides us with access to additional data from which all of our clients can benefit.
